Introduction

The scaperelaxation.com website (the "Website"), the Scape Relaxation Mobile Application (the "App"), scaperelaxation.app, and any related digital platforms (collectively, the "Service") is provided by Scape Relaxation, LLC, a Florida limited liability company ("Scape Relaxation," "we," or "us"). These Terms of Use ("Terms") apply to the Service where they are posted and/or referenced. By using the Service, you accept these Terms. Please read them carefully. By using the Service, you also certify that you are above the age of majority in your jurisdiction of residence. The Service is intended for use by individuals who are age 18 or older only; minors are excluded.

Modification

We reserve the right to modify these Terms at any time. By continuing to use the Service after we post any such modifications, you accept the modified Terms.

Privacy

Any personal information you provide through the Service will be used by us in accordance with our Privacy Policy, the terms of which are incorporated herein by reference.

Your Account

You are responsible for the confidentiality of your account and your password, as well as all statements made and acts or omissions that occur on your account. If you believe someone has used your password or account without your authorization, you must notify us immediately. Your account may also be restricted or terminated for any reason, in our sole discretion. We may also change, restrict access to, suspend, or discontinue the Service, or any portion of the Service, at any time without notice.

Consent to Electronic Communications

When you visit the Service or send an email, text message, or other communication from your devices to us, you are communicating with us electronically. You consent to receive communications from us electronically. We may communicate with you in various ways, such as by email, text, in-app push notices, or by posting notices and messages on the Service. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

SMS/Text Message Terms

By providing your phone number and opting in to SMS notifications, you consent to receive text messages from Scape Relaxation LLC regarding your membership and appointments. By opting in, you agree to the following:

  • Message Types: Appointment reminders, booking confirmations, check-in reminders, and important account notifications
  • Message Frequency: Approximately 4 messages per month, varying based on your appointment activity
  • Message & Data Rates: Standard message and data rates may apply depending on your mobile carrier plan
  • Opt-Out: You may opt out at any time by replying STOP to any text message. You will receive a confirmation message and no further texts will be sent
  • Help: Reply HELP to any text message for support information, or contact us at clearwater@scaperelaxation.com or (727) 607-1300
  • Re-Subscribe: After opting out, you may opt back in by replying START or by enabling SMS in your notification settings at scaperelaxation.app/settings/notifications

SMS consent is not required as a condition of purchasing any goods or services. You may continue to use our facilities and services without opting in to text messages.

Supported Carriers: We support all major US carriers including AT&T, Verizon, T-Mobile, and most regional carriers. Carriers are not liable for delayed or undelivered messages.

Service Content

We, our suppliers, and/or Service visitors may post content on the Service, including, without limitation, service or merchandise information, product descriptions, reviews, and comments (collectively, "Service Content"). Service Content is presented for educational and informational purposes only. Despite our efforts to provide useful and accurate information, errors may appear from time to time. We do not warrant that Service Content is accurate, complete, reliable, current, timely, or useful.

Health Information

You acknowledge and agree that the Service Content and the services we provide are not a replacement for medical care and should not be construed as a substitute for medical examination, diagnosis, or treatment. Service Content should not be construed to indicate that any product or service is safe for you. You further acknowledge and agree that no medical diagnosis will be made, and that you will see a medical professional for any medical issues you may have. Always consult your medical professional for guidance before using any product or service.

You agree to inform your Scape Team in advance of any service about any pre-existing conditions, limitations, or specific sensitivities you may have. If you experience discomfort, pain, or are uncomfortable for any reason during a service, you agree that you will immediately ask the therapist to address your concern or to terminate the service. Inappropriate or illegal conduct will not be tolerated. We may, in our sole discretion, refuse or discontinue a service if we determine that the service may be unsafe or cause discomfort for you, or if you engage in any inappropriate conduct.

Online Orders

When placing an online order (including booking appointments, purchasing memberships, or gift cards), you must provide truthful and accurate billing and contact information. We reserve the right to cancel or refuse any proposed order for any reason, including errors in pricing or potential security concerns. You agree to pay for the products and services you select and any applicable fees and taxes.

Gift Cards

Scape Relaxation gift cards do not expire and are not subject to fees. They may only be used for services purchased online or in-store. Gift cards are non-refundable, non-reloadable, and cannot be redeemed for cash unless required by law. Lost or stolen gift cards will not be replaced.

Membership Programs

By subscribing to a membership program, you authorize us to charge your payment method monthly for membership fees. Unused benefits may roll over or be transferred to friends or family as per membership terms. You may upgrade, downgrade, or cancel your membership with 30 days' notice. We reserve the right to terminate memberships for non-payment or inappropriate conduct.
 

Third Parties

References to third-party names, marks, or services on the Service are not endorsements. We are not responsible for the content or actions of linked third-party sites.

Intellectual Property

All intellectual property on the Service, including content, graphics, and logos, is owned or licensed by Scape Relaxation. You may use the Service's content for personal, non-commercial purposes only. Unauthorized use is strictly prohibited.

Indemnity

You agree to indemnify and hold Scape Relaxation harmless from claims, damages, and expenses related to your use of the Service or violations of these Terms.

Limitation of Liability

Scape Relaxation is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claims will not exceed $100.

Disputes

Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Claims may not be brought as part of a class action or on behalf of others.

Disclaimer

The Service is provided "as is" without warranties of any kind. We disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose.

Applicable Law

These Terms are governed by the laws of the State of Florida without regard to conflict of laws principles.
